Treat Map — End User License Agreement & Terms of Use

These Terms of Use and End User License Agreement ("Terms") are a legal agreement between you and Innovaiden Inc. ("Innovaiden," "we," "us") governing your use of the Treat Map app and companion website (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. What Treat Map Is

Treat Map is a coordination tool for neighborhood trick-or-treat events. Organizers create a neighborhood; hosts list their house; and trick-or-treaters browse a map, see participating houses, and leave reactions. Treat Map is a directory and coordination service only. We do not organize, supervise, vet, or endorse any event, neighborhood, host, or attendee, and we are not a party to any interaction between users.

2. Eligibility, Age, and Parental Consent

You may use the App only if you can form a binding contract with us and are permitted to do so under the laws of your country. The App is family-facing and open to users of many ages, but:

  • If you are under the age of digital consent in your country (which varies — for example, 13 in Sweden and under COPPA in the United States, and up to 16 elsewhere in the EU), you may use the App only with the involvement and verifiable consent of a parent or guardian, obtained as described in the Privacy Policy.
  • A parent or guardian who consents to a minor's use is responsible for supervising that use and accepts these Terms on the minor's behalf.
  • Children should trick-or-treat only under the supervision of a responsible adult. The App does not replace adult supervision.

3. Your Account

You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the App.

4. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial participation in Treat Map events. You may not copy, modify, reverse-engineer, resell, or misuse the App or attempt to access it other than through the interfaces we provide.

5. User Content

You may create content in the App — neighborhoods, host listings, availability notes, reactions, and reviews ("User Content"). You retain ownership of your User Content and grant us a worldwide, royalty-free license to host, display, and distribute it solely to operate and provide the App (for example, showing your host listing to your neighborhood's participants). You are solely responsible for your User Content and represent that you have the right to share it and that it complies with these Terms.

6. Community Rules — Zero Tolerance for Objectionable Content and Abuse

Because the App is used by families and children, we enforce a zero-tolerance policy for objectionable content and abusive behavior. You must not use the App to:

  • post content that is unlawful, harassing, hateful, threatening, sexually explicit, or otherwise objectionable;
  • harass, endanger, deceive, or exploit any person, especially a minor;
  • impersonate any person, or misrepresent a neighborhood, address, or affiliation;
  • collect, publish, or misuse other people's personal information;
  • create fake, unsafe, or malicious host listings or neighborhoods; or
  • interfere with, disrupt, or attempt to gain unauthorized access to the App or others' accounts.

We do not tolerate objectionable content or abusive users. Violations may result in immediate content removal and account suspension or termination.

7. Reporting, Moderation, and Enforcement

  • Reporting. You can report objectionable content, unsafe listings, or abusive users from within the App. Reports are reviewed and acted on, and we aim to remove violating content and take action against the responsible account promptly (and, for content reported as objectionable, within 24 hours of an actionable report).
  • Blocking. You can leave a neighborhood at any time, and organizers can remove or ban a participant from their neighborhood.
  • Moderation of public neighborhoods. A neighborhood set to appear in public discovery is reviewed before it is publicly listed. We may refuse, delay, hide, remove, or reclassify any neighborhood, listing, or content, and may suspend or terminate any account, at our discretion, to keep the community safe.

8. Host Responsibilities and Safety

If you register as a host, you are solely responsible for your participation, for the accuracy of the address and entry information you provide, and for the safety of anyone you invite to your property. Share a door or building entry code only if you are entitled to and intend to. Treat Map does not verify hosts, attendees, addresses, or door codes, and does not guarantee that any listing is accurate, safe, or legitimate. Use common sense and take the same precautions you would for any in-person neighborhood event.

9. Safety Disclaimer

Trick-or-treating and neighborhood events involve real-world, in-person interactions that carry inherent risks. You participate at your own risk. Innovaiden does not supervise events, vet participants, or guarantee anyone's conduct or safety. Adults are responsible for supervising children. Nothing in the App should be relied on as a safety assurance about any person, home, or neighborhood.

10. Sponsors and Third-Party Content

Neighborhoods may display sponsor names or logos. Sponsors and any third-party links are not endorsements, and we are not responsible for third parties or their content. See the Privacy Policy for how sponsor communications work (opt-in only).

11. Intellectual Property

The App, excluding User Content, is owned by Innovaiden and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any listing or user is accurate, safe, or trustworthy. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you; nothing in these Terms limits rights you have as a consumer that cannot be waived under applicable law.

13. Limitation of Liability and Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOVAIDEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP OR FROM ANY IN-PERSON INTERACTION BETWEEN USERS. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud). You agree to indemnify Innovaiden against claims arising from your User Content, your participation in events, or your breach of these Terms, except to the extent prohibited by law.

14. Apple App Store — Licensed Application Terms

If you obtain the App from the Apple App Store, the following also apply: these Terms are between you and Innovaiden only, not Apple; Apple has no obligation to provide support or maintenance for the App; in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the App or your use of it; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. embargo or on a U.S. prohibited-parties list.

15. Changes; Termination

We may update these Terms from time to time; material changes will be reflected in the "Last Updated" date and, where appropriate, noticed in the App. We may suspend or terminate your access for any violation of these Terms or to protect users. You may stop using the App and delete your account at any time.

16. Governing Law

These Terms are governed by the laws applicable to Innovaiden Inc., without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection laws of your country of residence (including, for EU/EEA and Swedish consumers, the protections of your local law). Counsel to specify the governing-law and venue clause.
