Roots — End User License Agreement & Terms of Use

These Terms of Use and End User License Agreement ("Terms") are a legal agreement between you and Innovaiden Inc. ("Innovaiden," "we," "us") governing your use of the Roots family tree app and companion website (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. What Roots Is

Roots lets a family build a shared, private family tree: relatives with names, dates, and places; photos and galleries; written stories; and recordings of family conversations that Roots can transcribe and turn into suggested tree entries using AI. A tree is created by its owner and is visible only to the family members the owner invites or approves. Roots is a private record-keeping tool. We do not verify genealogical accuracy, and a tree reflects only what its members choose to record.

2. Eligibility and Age

You may create a Roots account only if you can form a binding contract with us and are at least the age of digital consent in your country (16 in the EU/EEA/UK, 13 in the United States and most other countries). Information about children may be added to a tree by adult family members under the tree owner's responsibility, as described in the Privacy Policy — but accounts themselves are for people at or above these ages.

3. Your Account and Your Tree

You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the App. If you own a tree, deleting your account permanently deletes the tree and all of its content for every member. Consider exporting (Section 8) or transferring stewardship before you do this.

4. Roles, Invites, and Family Access

A tree owner can invite relatives by code and assign each member a role (viewer, editor, or admin). By inviting someone, you are sharing everything their role and access scope lets them see. Editors and admins can add and change tree content that other members will see, and their contributions are recorded with their name. You are responsible for whom you invite; we do not vet members of your family.

5. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial family record-keeping. You may not copy, modify, reverse-engineer, resell, or misuse the App or attempt to access it other than through the interfaces we provide.

6. Your Content — and Information About Your Relatives

You and your family create the content in a tree — people entries, dates, places, relationships, photos, stories, and recordings ("Family Content"). You retain ownership of the Family Content you contribute and grant us a worldwide, royalty-free license to host, display, and process it solely to operate and provide the App (for example, showing a photo you add to the other members of your tree, or transcribing a recording you upload so you can review suggested entries).

A family tree naturally describes people other than the person typing. When you add information about relatives — living or deceased, members or not — you represent that you are entitled to record it in a private family context, and you agree to remove or correct entries about a living relative at their reasonable request. Record conversations only with the knowledge and consent of the people being recorded. Recording laws vary by country and state, and obtaining any required consent is your responsibility, not ours.

AI-generated suggestions (from transcripts or documents) are proposals only — nothing is added to your tree until a member reviews and applies it. Suggestions can be wrong; review them the way you would any unverified note.

7. Community Rules — Zero Tolerance for Objectionable Content and Abuse

Even in a private family space, we enforce a zero-tolerance policy for objectionable content and abusive behavior. You must not use the App to:

  • post content that is unlawful, harassing, hateful, threatening, sexually explicit, or otherwise objectionable;
  • harass, endanger, deceive, or exploit any person, especially a minor;
  • impersonate any person or misrepresent a family relationship for a deceptive purpose;
  • publish or misuse another person's personal information outside the private family context the App provides;
  • upload content you have no right to share (including photos or recordings made without required consent); or
  • interfere with, disrupt, or attempt to gain unauthorized access to the App, other trees, or others' accounts.

Violations may result in immediate content removal and account suspension or termination.

8. Your Data, Export, and Portability

Your family's tree belongs to your family. You can export the entire tree at any time as a standard GEDCOM file — free, on every plan — from Settings → Your Data. Deleting your account (or a tree owner deleting the tree) permanently removes the content as described in the Privacy Policy.

9. Roots Premium, Subscriptions, and Purchases

Parts of the App are free; Roots Premium unlocks higher limits (such as unlimited people and media) and premium features. Premium is purchased through Apple as an auto-renewing subscription or a one-time lifetime purchase, and applies to the whole tree — one family member's Premium benefits every member of that tree.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel in your device Settings → your Apple ID → Subscriptions.
  • Prices are shown in the App before purchase. Refunds are handled by Apple at reportaproblem.apple.com.
  • If Premium lapses, your content is never deleted — features and limits simply return to the free tier.

10. Intellectual Property

The App, excluding Family Content, is owned by Innovaiden and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any tree entry, AI suggestion, or transcription is accurate or complete. Roots is a family record, not an authoritative genealogical, legal, or medical source. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you; nothing in these Terms limits rights you have as a consumer that cannot be waived under applicable law.

12. Limitation of Liability and Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOVAIDEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP, FROM CONTENT ADDED BY MEMBERS OF YOUR TREE, OR FROM ANY DISPUTE BETWEEN FAMILY MEMBERS. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud). You agree to indemnify Innovaiden against claims arising from your Family Content, recordings you make or upload, or your breach of these Terms, except to the extent prohibited by law.

13. Apple App Store — Licensed Application Terms

If you obtain the App from the Apple App Store, the following also apply: these Terms are between you and Innovaiden only, not Apple; Apple has no obligation to provide support or maintenance for the App; in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the App or your use of it; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. embargo or on a U.S. prohibited-parties list.

14. Changes; Termination

We may update these Terms from time to time; material changes will be reflected in the "Last Updated" date and, where appropriate, noticed in the App. We may suspend or terminate your access for any violation of these Terms or to protect users. You may stop using the App and delete your account at any time.

15. Governing Law

These Terms are governed by the laws applicable to Innovaiden Inc., without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection laws of your country of residence (including, for EU/EEA and Swedish consumers, the protections of your local law). Counsel to specify the governing-law and venue clause.
